Terms of Service

1. About these terms
These Terms of Service ("Terms") are a contract between you and HostPanel ("HostPanel", "we", "us") governing your use of our cloud hosting, server, and related services (the "Services"). By creating an account or using the Services you agree to these Terms. If you are using the Services on behalf of a company, you confirm you have authority to bind that company.
2. Your account
- You must be at least 18 years old and provide accurate, up-to-date registration and billing information.
- You are responsible for keeping your credentials secure and for all activity on your account. We strongly recommend enabling two-factor authentication.
- Tell us promptly at support@hostpanel.co.uk if you believe your account has been compromised.
3. Acceptable use
You may use the Services for any lawful purpose. You must not use them to:
- Host, distribute, or link to content that is illegal under the laws of England and Wales, including material that infringes intellectual property rights, malware, or phishing content.
- Send unsolicited bulk email (spam) or operate services whose primary purpose is sending spam.
- Run cryptocurrency mining or similar sustained compute-abuse workloads on plans not expressly sold for that purpose.
- Originate, participate in, or facilitate denial-of-service (DoS/DDoS) attacks, port scanning, or other attacks against any network or system.
- Attempt to gain unauthorised access to our infrastructure or other customers' services, or interfere with the integrity or performance of the platform.
We may investigate suspected violations and remove content or suspend services where necessary to protect our platform, other customers, or third parties.
4. Payments and renewals
- All prices are in pounds sterling (GBP). VAT is added where applicable and shown at checkout.
- Services are billed monthly in advance and renew automatically unless you cancel before the renewal date.
- The price you sign up at is the price you renew at. We do not use introductory pricing that jumps at renewal. If we ever change the price of your plan, we will give you at least 30 days' notice before the change applies to you.
- If a payment fails, we will retry it and notify you. Services with unpaid invoices may be suspended after 7 days and terminated after 30 days, after which data may be deleted.
- You can cancel at any time from your dashboard. Cancellation stops the next renewal; fees already paid for the current billing period are non-refundable except where the law or our SLA says otherwise.
5. Fair use of unlimited features
Where a plan feature is described as "unlimited" or "unmetered", it is unlimited for normal use of that plan type — we do not count or cap it in ordinary operation. It is not a licence to use the feature in ways that degrade the platform for others, such as using web hosting storage as a backup or file distribution archive, or sustaining resource consumption far beyond what comparable customers on the same plan use. If your usage is materially outside fair use, we will contact you first and work with you to find a suitable plan before taking any action.
6. Your content and data
You retain all rights to the content and data you host with us. You grant us only the limited rights needed to store, transmit, and back up that content in order to provide the Services. You are responsible for ensuring you have the rights to the content you host and for keeping your own copies of critical data in addition to any backups we provide.
7. Suspension and termination
- We may suspend a service immediately where necessary to deal with a security incident, legal requirement, non-payment, or a serious breach of the acceptable use rules in section 3. Where reasonable, we will notify you and give you the chance to fix the issue first.
- We may terminate your account for material breach of these Terms if the breach is not remedied within 14 days of notice, or immediately for serious violations such as illegal content or attacks on our network.
- After termination, we retain your data for 30 days so you can retrieve it (unless we are legally prevented from doing so), after which it is permanently deleted.
8. Service levels and warranties
Our uptime commitment and the service credits available when we miss it are set out in our Service Level Agreement. Except as expressly stated in these Terms or the SLA, the Services are provided "as is" and we exclude all other warranties to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights.
9. Limitation of liability
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under the laws of England and Wales.
- Subject to that, we are not liable for indirect or consequential losses, loss of profits, loss of revenue, or loss of data (beyond restoring from available backups).
- Our total aggregate liability arising out of or in connection with the Services in any 12-month period is limited to the fees you paid to us in that period.
10. Changes to these terms
We may update these Terms as our Services evolve. For material changes we will give you at least 30 days' notice by email or dashboard notification. If you continue using the Services after a change takes effect, the updated Terms apply. If you do not agree to a change, you may cancel before it takes effect.
11. Governing law
These Terms and any dispute arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction — although if you are a consumer, you keep the benefit of any mandatory protections of the country you live in.
